iRides Marketplace Terms and Conditions

1. Marketplace role

iRides is a technology marketplace operated by Ingenious Technology to connect vehicle owners, renters, drivers, and related service providers. iRides is not the owner, operator, manufacturer, insurer, mechanic, chauffeur, security provider, or employer of any vehicle or person listed through the platform unless expressly stated in writing.

Users understand that bookings, handovers, vehicle condition, driving conduct, and service delivery involve independent parties. iRides provides discovery, booking, payment, wallet, escrow, compliance, communication, and dispute-support tools, but does not guarantee the actions, omissions, driving, safety, fitness, legality, or reliability of any user, vehicle, driver, owner, renter, third-party provider, or external service.

2. General user obligations

All users must provide accurate account information, maintain current contact details, complete required KYC, obey applicable laws, use the platform in good faith, avoid fraud or misrepresentation, and cooperate with compliance, dispute, security, and safety reviews.

Users must not bypass platform payments, harass other users, submit forged documents, list unavailable or unsafe vehicles, use rented assets for unlawful activities, or interfere with escrow, payout, refund, or review processes.

3. Renter obligations

Renters are responsible for reviewing vehicle details, booking times, pricing, cancellation rules, pickup details, and drive options before payment. Renters must return vehicles on time and in the received condition except for ordinary wear.

Self-drive renters must hold a valid driver's license, submit driver's-license KYC, comply with traffic laws, and avoid reckless use. Before each self-drive session starts, the renter receives a separate location-tracking disclosure and must make an affirmative choice. Declining tracking prevents that self-drive session from starting but does not prevent use of unrelated iRides features.

During an active self-drive session, iRides may collect precise location to support trip safety, vehicle recovery, authorised owner monitoring, customer support, and dispute handling. On supported mobile devices this may continue while the app is minimised, closed, or not otherwise in active use. Tracking stops when the session ends. The last accepted location and recent route are retained for no more than 48 hours after session end and are then scheduled for deletion. Location is not used for advertising. 4. Owner obligations

Owners are responsible for accurate listings, lawful ownership or authority to list, roadworthiness, insurance disclosures, vehicle documents, availability, pricing, pickup readiness, and condition documentation. Owners who enable self-drive must accept the self-drive compliance obligations and understand that iRides is not responsible for user-caused loss, traffic incidents, fines, misuse, damage, or off-platform conduct.

5. Driver obligations

Drivers must maintain valid driver's licenses, complete driver KYC, obey traffic and safety laws, show professional conduct, and only operate trips assigned through approved platform workflows. Drivers are independent users or service providers unless a separate written employment agreement says otherwise.

6. Payments, escrow, payouts, and refunds

iRides may collect booking payments, service fees, deposits, extension payments, penalties, refunds, and other charges through payment partners. Funds may be held in escrow or wallet pending trip completion, dispute windows, manual review, compliance checks, or payout processing.

Ordinary marketplace refunds, including cancellation refunds and caution-deposit returns, are credited to the renter's Ingenious Pay wallet first. The renter may use the wallet balance for another booking or request withdrawal to a verified Nigerian bank account. A wallet credit completes iRides' marketplace refund obligation for that amount; a later bank withdrawal is a separate user-requested transfer and may be affected by payment-provider or bank processing times.

For a renter cancellation, the refundable rental amount follows the vehicle's cancellation policy. Unused chauffeur, driver, and security add-ons and the caution deposit are returned before the trip starts, including for a non-refundable rental rate, unless a lawful damage, fraud, chargeback, or other documented claim applies. The separately disclosed iRides service fee, VAT charged on that retained service fee, and Paystack processing fee are not refunded for a renter cancellation, including a cancellation made within a free rental-cancellation window. "Free cancellation" therefore means no cancellation deduction from the refundable rental fare; it does not mean that already disclosed payment and platform charges are reversed.

If the owner or iRides cancels for owner/platform fault before the trip, the renter receives the gross paid amount in the Ingenious Pay wallet, including the rental, unused add-ons, caution deposit, service fee, VAT, and disclosed gateway fee. Any payment-provider charge that Paystack does not return is recorded against the responsible owner where the owner caused the cancellation and may be recovered from future owner earnings or other amounts due.

Duplicate charges, technical overcharges, and reversals required by law are not processed as ordinary wallet cancellation refunds. They are submitted against the original Paystack transaction and returned to the original payment method, subject to provider verification and processing. iRides records the refund status and issues the corresponding accounting correction or credit note. Nothing in this section limits a refund or reversal that applicable law requires.

Payouts, refunds, and deposit returns depend on booking status, cancellation policy, dispute outcome, payment-provider confirmation, wallet status, bank details, and compliance state. Payment timelines can be affected by third-party processors and banks.

7. Cancellations, late returns, extensions, and no-shows

Cancellation rights and rental-fare deductions depend on the cancellation policy displayed before payment and snapshotted on the booking. Same-day and late-cancellation rules shown at checkout may reduce the refundable rental fare. The caution deposit is security for trip-related claims and is not a cancellation penalty when the trip has not started. Late returns, unauthorized extensions, no-shows, missed sessions, or extra use may lead to additional charges, deposit deductions, restricted access, or account suspension.

8. Disputes and evidence

Users should capture handover and return evidence. iRides may review photos, videos, GPS evidence, timestamps, communications, payment data, and user submissions. Admin decisions may release payouts, refund renters, apply penalties, dismiss disputes, or split funds based on available evidence.

9. Compliance and policy updates

iRides may publish updated terms, policy variants, KYC requirements, compliance notices, and operational rules to all users or specific segments such as owners, renters, drivers, businesses, or admins. Continued use after publication may require acceptance of the latest policy version.

10. Liability limitation

To the fullest extent allowed by law, iRides and Ingenious Technology are not liable for accidents, injury, death, theft, loss, fines, traffic violations, vehicle failure, user misconduct, incorrect listings, third-party payment failure, bank delays, off-platform agreements, or consequential damages arising from interactions between independent users.

Nothing in these terms excludes liability that cannot legally be excluded. Where liability cannot be excluded, it is limited to the amount permitted by law and, where applicable, the platform fees paid to iRides for the affected transaction.

11. Enforcement

iRides may restrict features, withhold payouts subject to review, request additional documents, suspend accounts, remove listings, notify affected users, or report suspected illegal activity where necessary for safety, compliance, fraud prevention, or dispute handling.
